Lawsuit alleges Tucson Finance Agency discriminated against pregnant employees
TUCSON, Arizona (KOLD News 13) – The Arizona Attorney General has filed a lawsuit against a Tucson-based insurance agency for allegedly discriminating against an employee for a pregnancy-related disability she had last year.
The Arizona Attorney General has filed a discrimination complaint against JD Mellberg Financial, a Tucson-based national insurance agency, Attorney General Mark Brnovich said Friday.
According to the attorney general’s office, the employee suffered from placenta previa, a disease that restricts mobility and is treated with bed rest. Although she had several notes from her doctor describing her condition, she said in the press release that the agency had forced her to take unpaid sick leave instead of allowing her to work from home before taking out their health insurance quit and she quit.
AGO said the agency claimed through its lawyer that “pregnant women should not be allowed to work during the COVID-19 pandemic”.
The lawsuit filed by AGO argues that JD Mellberg violated the Arizona Civil Rights Act by failing to provide the woman with reasonable accommodation for her disability, terminating her employment, and retaliatory against her.
An attempt on Friday to reach JD Mellberg for an answer to the allegations was unsuccessful.
