YUMA, Arizona (KVOA) – An inmate charged with indecent behavior on a child was arrested by border patrol Tuesday night after agents from the Yuma sector located a group of 12 migrants in the Cabeza Prieta Wildlife Refuge.

According to US Customs and Border Protection, 30-year-old Brian Cruz-Gutierrez and eleven other undocumented non-citizens tried to evade law enforcement by traveling through the wild refuge southeast of Yuma.

After agents at Wellton Station arrested the group, Border Patrol learned that Cruz-Gutierrez was charged in 2013 in Pomona, California, with indecent or lascivious acts on a child under the age of 14.

Officials said the 30-year-old was deported from the US in 2016 after serving a three-year prison sentence for conviction.

CBP said Cruz-Gutierrez will be prosecuted for re-entry of a felon following a previous deportation.
